Terms of Service

1. Acceptance of Terms

By accessing or using the EmailFunnelAI platform, website, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you and EmailFunnelAI. We may update these Terms from time to time, and your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

2. Description of Service

EmailFunnelAI provides an AI-powered email funnel builder with Telegram integration. The Service allows users to create, manage, and automate email marketing funnels using artificial intelligence. Features include but are not limited to: AI-generated email sequences, automated follow-up campaigns, Telegram bot integration, analytics and reporting, and third-party integrations.

3. Account Registration

To use certain features of the Service, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information during the registration process.
• Maintain and promptly update your account information to keep it accurate and complete.
• Maintain the security and confidentiality of your login credentials.
• Accept responsibility for all activities that occur under your account.
• Notify us immediately of any unauthorized use of your account.

4. Subscription and Payment

EmailFunnelAI offers both free and paid subscription plans. For paid plans:

• Fees are billed in advance on a monthly or annual basis, depending on the plan selected.
• All fees are non-refundable except as expressly stated in these Terms or required by applicable law.
• We reserve the right to change our pricing at any time. Changes will be communicated at least 30 days in advance.
• If payment fails, your account may be downgraded or suspended until payment is resolved.

5. Acceptable Use

You agree not to use the Service to:

• Send unsolicited emails or spam in violation of applicable anti-spam laws (CAN-SPAM, GDPR, etc.).
• Transmit any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Interfere with or disrupt the Service or servers or networks connected to the Service.
• Attempt to gain unauthorized access to any portion of the Service or any other systems or networks.
• Use the Service for any illegal purpose or in violation of any local, state, national, or international law.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of EmailFunnelAI. The Service is protected by copyright, trademark, and other intellectual property laws. You retain ownership of any content you create using the Service, but grant EmailFunnelAI a license to use, store, and process such content as necessary to provide the Service.

7. Data and Content

You are solely responsible for the content you create, upload, or distribute through the Service. You represent and warrant that you have all necessary rights to the content you use with the Service and that your use does not violate any third party's rights. EmailFunnelAI does not claim ownership over your content but requires certain rights to operate the Service effectively.

8. Limitation of Liability

To the maximum extent permitted by applicable law, EmailFunnelAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service. In no event shall EmailFunnelAI's total liability exceed the amount you have paid to EmailFunnelAI in the twelve (12) months preceding the claim.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Bangladesh, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms shall be resolved in the courts of Bangladesh.
